Shakespeare did observe the 5-act structure although, as you've mentioned, many gory scenes were done on stage.
Recent scholarship (meaning Shakespeare would not have known this) has revealed that the "rules" for theatre were not being given as strict guidelines by which to write a play; they were simply descriptions of dramas of the time. I guess it's a subtlety of the Greek language but one of my English professors said what we considered to be rules for the longest time, or "prescriptions" of how one must do a play, were actually "descriptions" of the dramas written during the time of Sophocles and Euripides.
